Acceptance of Terms
The following are the Terms and conditions for Imasa Lifestyle(“Agreement”.). In using the Imasa Lifestyle (“Imasa Lifestyle”, “we,” “us,” or “our”) website, www.imasa.ie, you are agreeing to abide by the Privacy Policy and Terms and Conditions. Please take note that both the Privacy Policy and Terms and Conditions are legally binding agreements between you and Imasa Lifestyle.
General
1. Privacy
The Privacy Policy forms part of this Agreement. By using this Website, you are consenting to the use of your particulars only for the requirements described in our Privacy Policy. Your privacy is very important to Imasa Lifestyle.
2. Suspension of Services
Occasionally, due to maintenance, updating, or forces beyond our control, access to the website may be temporarily limited or restricted. Imasa Lifestyle will strive to keep these interruptions to an absolute minimum and will endeavour to have the website available at all times.
3. Prohibited Use of Website
In using this website you understand and agree that you must not misuse this website in any way. 4. Termination
You acknowledge and agree that Imasa Lifestyle has the right to terminate or suspend your access to the website, including deletion of your account details if you breach this Agreement or if we believe that you are operating in an illegal or immoral manner and/ or to the detriment of Imasa Lifestyle and its services.
5. Intellectual Property
You understand and agree that the intellectual property rights to all technology, software and content acquired via this website are and remain the sole property of Imasa Lifestyle or its Licensors and are protected by copyright law. You may use the images and content supplied solely for your own personal referral. You are not permitted to publish, reproduce or disseminate in any way any of the content of this website. You are not permitted to use any content or images from this website in connection with any commercial enterprise.
Liability
1. Disclaimer of Liability
In using this website you agree to indemnify Imasa Lifestyle against any damages whatsoever, including but not limited to any direct, indirect, punitive or incidental damages, or special or consequential damages for economic loss, loss of or impairment to reputation or goodwill, interruption to conduction of business, arising out of your use of the website or restriction of use of the website, irrespective of whether such damages were foreseeable or whether Imasa Lifestyle was alerted to their existence, or whether they arise in tort, contract, equity, restitution or otherwise. You agree to indemnify Imasa Lifestyle against any claim, action, demand, loss, damages, made by your or a third party relating to your breach of this Agreement or your use of the website and content.
Terms of Sale
1. Ordering
Imasa Lifestyle endeavours to ensure that all the information contained in listings and descriptions is correct and accurately relays the product details to you for information purposes. However, we do not give any warranty or guarantee as to the information’s accuracy or veracity. By using the website you acknowledge and agree that although Imasa Lifestyle make every effort to ensure the correctness of the information in our listings and descriptions, Imasa Lifestyle are not liable for any claims, losses or damages arising from the information provided by Imasa Lifestyle.
When you have submitted an order to Imasa Lifestyle we respond with an acknowledgement mail. This is merely confirmation that we have received your order and does not constitute a legal binding contract. Acceptance of your order and formation of contract will take place when the product or gift is delivered to you upon cleared or guaranteed payment. This does not affect any of your statutory rights.
2. Pricing Error
Imasa Lifestyle endeavours to ensure that all details, descriptions and prices of all of our products are accurate. However, despite our best efforts, errors may occasionally occur. If an error is discovered in the price we will attempt to contact you as soon as is reasonably possible. You then have the option to re-confirm your order at the correct price or cancelling it. If we are not able to reach you to alert you to the error, we will treat the order as cancelled and inform you via the email address you provided Imasa Lifestyle with. If you have already paid for the goods and we inform you of a pricing error, you will receive a full refund.
3. Returns
Imasa Lifestyle values customer satisfaction. With this in mind it operates a no-quibble ten-day return policy. This guarantee only applies to private customers purchasing products for personal use, and does not apply to a customer operating as a trader or wholesale agent.
In the unlikely event that a customer wishes to return a product to Imasa Lifestyle he or she should contact Imasa Lifestyle within ten days of taking receipt of the product. The customer must then return the product to Imasa Lifestyle, 110 o’ Connell Street Limerick.
We will refund the cost of the item(s) ordered excluding cost of return postage
Where we collect an item from you, we reserve the right to recover the costs of collection from you.

4. Delivery
Imasa Lifestyle arranges delivery to anywhere in Ireland for a flat fee of €7.95. Imasa Lifestyle will endeavour to deliver your product or gift to the address supplied as quickly as reasonably possible, which is usually the very next day anywhere in Ireland but will not be liable or responsible for any loss or damage caused by delay in delivery. Delivery to the UK usually takes place within three to four days.
Miscellaneous
1. Waiver
If you breach any of the conditions of this Agreement and we take no action, we reserve the right to use our rights and remedies in any other situation in which you contravene these conditions
2. Customer Comments
At Imasa Lifestyle we value your opinion. Please let us know if you have any complaints or comments so that we can try to resolve your issue quickly or use your feedback to better our service.
3. Links
Imasa Lifestyle does not accept responsibility nor a duty of care for the contents of any of the third party websites accessible through links on the website. Imasa Lifestyle does not make any representation express or implied in relation to the veracity of the contents of any website linked to www.imasa.ie; nor does the existence of any link constitute any implied endorsement of any website, its operator, or their products. No views expressed on that website should be considered to also be the views of Imasa Lifestyle
4. Force Majeure
You acknowledge and agree that Imasa Lifestyle will not be liable for any breach of this Agreement caused by circumstances beyond its control including, but not limited to Acts of God, fire, lightening, flood, or extremely severe weather, explosion, war, disorder, flood, industrial disputes (external or internal), acts or omissions of internet service providers or acts of government or state bodies.
5. Advertising
Imasa Lifestyle does not accept responsibility nor a duty of care for the any correspondence or commercial transactions with any of the advertisers accessible through the website. You acknowledge and agree that Imasa Lifestyle shall not be liable for any loss or damage of any sort due to any dealings with advertisers or as the result of the hosting of such advertisers on the website.
6. Governing law and jurisdiction
You acknowledge and agree that this Agreement and the relationship between Imasa Lifestyle and you are to be construed in accordance with Irish law. Any dispute or claim shall be subject to the exclusive jurisdiction of the Irish legal system.
